歡迎使用｢寵物星语｣（以下簡稱「本遊戲」)。以下服務條款 (包括有關連結及政策，以下簡稱「本服務條款」) 適用於所有使用本遊戲及/或在本遊戲及/或網址 https://ps.xpecgame.com/index.html 及其轉發網站）提供的任何服務（該等服務以下簡稱「本遊戲｣，該網站以下簡稱「服務網站」）的訪客及/或用戶。您進入及／或使用本遊戲及/或服務網站，即表示您同意接受本服務條款及條件約束。

1. 「本遊戲」及「服務網站」

1.1 您只能透過設有相容作業系統的電腦下載及使用本遊戲，詳情請留意本遊戲及服務網站內的系統說明。

1.2 透過流動網絡使用本遊戲有可能衍生流動數據費用，詳情請向您的流動電訊服務供應商查詢。

1.3 本遊戲及服務網站均由我們擁有或控制，為向您提供有關本遊戲的資訊及方便您使用而設立。

1.4 本公司授權您進入及使用本遊戲及有關內容是以您嚴格遵守本服務條款的各項條款為條件。

2. 本公司的權利和責任

2.1 「本公司」及「我們」是指根據本服務條款提供本遊戲的 XPEC ENTERTAINMENT LIMITED 及/或其關聯公司。

2.2 本公司可：

(a) 隨時變更、修改、暫停、增加或移除本遊戲的任何功能或特性（包括但不限於調整本遊戲的遊戲規則、移除遊戲物品、角色經驗及等級、互動地圖、遊戲物品的效果、任務的達成條件及遊戲的控制等）、增加或設立使用限制，並可同時暫停或停止本遊戲；
(b) 隨時中止本遊戲以便進行系統維修、提升、測試及／或修理，而無須給予通知；
(c) 在本公司認為適當的情況下，就您使用本遊戲或違反本服務條款的任何條款而限制或暫停您使用本遊戲，並無須給予通知；及
(d) 在本公司認為任何本遊戲及╱或有關內容違反任何適用法律、規例或監管性指令或在其他方面不可接受的情況下，擴充、縮減、移除﹑取消及／或修改本遊戲的任何部分及／或任何有關內容（指本遊戲及／或於服務網站所提供或出現的任何內容，包括但不限於可透過或於本遊戲獲取的任何數據、資料、影像、圖像、影音內容、應用程式、可下載檔案或其他多媒體內容）。
(e) 通過遊戲管理員（以下簡稱「GM」）對用戶發佈的違規言論採取必要管理措施，包括但不限於刪除相關內容或對使用者實施暫時性或永久性禁言（以下簡稱「禁言措施」）。禁言措施的具體時長由本公司根據違規行為的性質、嚴重程度、歷史記錄及其他相關因素自行酌情決定。違規言論包括但不限於以下類型：

(i) 發佈損害本公司及/或本遊戲商譽、聲譽的言論；
(ii) 發表導致其他用戶不安、恐慌或騷擾的言論；
(iii) 傳播色情、賭博、暴力或其他違反香港法律的非法內容。

3. 您的帳戶

3.1 您必須為根據您所居住國家的法律達成年的自然人，及未被我們禁止使用我們的服務。根據您所居住國家的法律，如您已滿13歲，您亦可在法律容許您訂立合約及您的父母或合法監護人已閱讀及同意本服務條款的情況下可使用本遊戲。

3.2 您須註冊（或已註冊）一個本遊戲帳戶以進入本遊戲的部份功能，我們可不時全權決定拒絕或取消任何帳戶的註冊而無須任何原因、通知或負任何責任。

3.3 您須採取任何切實可行的措施保密您本遊戲帳戶的登入詳情（「登入詳情」）及不與他人分享登入詳情。您須對您的登入詳情及本遊戲帳戶的使用負全責，不論是否在您的授權下使用。如您知悉或有理由懷疑您的登入詳情遺失、被盜或被未經授權使用，您須立即通知我們。

4. 您的責任

4.1 您 :

(a) 只獲授權根據本服務條款使用本遊戲及進入有關內容作您的個人及非商業用途；
(b) 須遵守不時修訂的所有相關的適用法律及任何操作及／或使用守則；
(c) 須向我們舉報任何違反本服務條款的行為；及
(d) 如在某些情況下向本遊戲提供內容：

(i) 當您向本遊戲提供內容時，您只會提供沒有侵犯他人權利（包括知識產權）或違反法律的內容；
(ii) 您所提供的內容不可為淫褻性或誹謗性；
(iii) 就任何您所提供的內容，您授予我們非獨家、永久、可轉讓、有再授權、無須付授權費及在全世界使用該等內容的權利；
(iv) 您確認如我們發現任何您所提供的內容有違反本服務條款時，我們可全權決定移除該等內容。

4.2 您同意不會：

(a) 將本遊戲用作商業用途;
(b) 複製、修改、分發、銷售或租賃本遊戲的任何部份或包含的軟件，或倒序工程或試圖抽取該軟件的原代碼，除非法律禁止此等限制；
(c) 限制或阻止任何其他人士使用本遊戲，包括但不限於透過「非法入侵」或破壞本遊戲及／或服務網站任何部分；
(d) 利用外掛程式、作弊程式、自動化執行軟件（bots）、駭客程式、遊戲模組（mods）、遊戲程式漏洞或其他未獲授權的電腦程式設計以改變本遊戲或將本遊戲的功能供給多個使用者或帳戶，或產生與正常人類遊戲玩法不一致的任何行為、模式或行動；
(e) 干擾或擾亂本遊戲或連接本遊戲的伺服器或網絡；及
(f) 作出任何破壞遊戲平衡的行為（包括但不限於利用漏洞獲取不公平優勢或操縱遊戲經濟系統）。

5. 免責條款

5.1您確認已明白：

(a) 本遊戲及服務網站所提供的資訊均以「按現況」及「現有」之形式提供，並無任何明示或默示（不論基於成文法或普通法）的保證或條件，尤其是任何有關內容的準確性、特定目的適用性、無侵權、不中斷服務、可靠性、安全性、時間性及免於電腦病毒等明示或默示之保證或條件。我們不會因上述資訊的錯誤、遺漏、錯誤之陳述或不實之陳述（不論明示或默示）承擔任何責任；
(b) 本遊戲及／或服務網站可能會載有由第三者提供的材料及外部網站的超連結。我們聲明該等材料或超連結並沒有得到我們的核准或認可。由於外部網站並不在我們的控制範圍之內，因此該等網站的私隱性、安全性或連結性標準可能與我們的相關標準不相符。凡由第三者提供的材料或外部網站連結均不構成我們與第三者或外部網站任何形式的合作或聯繫，亦不構成任何有關我們贊同與否該等材料或網站之明示或默示陳述、聲明或保證。您與該等第三者的廣告商通訊或交易，或參與其推廣活動，僅涉及您與有關廣告商。本公司不會就因任何有關交易或因本遊戲及／或服務網站所顯示的連結及廣告而導致任何形式的損失或損害承擔或負上責任；
(c) 我們可不時透過應用程式發行商自動下載及安裝更新﹑升級及附加功能。當有新的更新﹑升級及附加功能出現後，我們無須支援舊有的版本，亦無須提供舊版本以供下載，縱使您的裝置不支援更新、升級及附加功能後的本遊戲；
(d) 凡因您的使用、不當使用、依據或通過本遊戲／服務網站傳遞的任何資訊；或不能使用本遊戲；或通過本遊戲／服務網站傳遞或提供的任何第三者材料之內容或外部網站的材料之內容；或不能使用本遊戲／服務網站，而引致或所涉及的損失、毀壞或損害（包括但不限於衍生性損失、毀壞或損害），我們一概不會承擔任何法律責任、義務或責任；
(e) 我們對本遊戲、本遊戲及服務網站的質素、解像度、完整性、準確性、用處、播放持續性、流暢性或時間性不作聲明、應允、擔保、承諾或保證；
(f) 您使用連結至本遊戲內不同網頁或網站時，可能會受附加或不同的條款及條件規管。在此情況下，您使用上述網頁或網站時，本服務條款和該等附加條款及條件將同時適用。如有歧義，概以該等附加條款及條件為準；
(g) 我們擁有所有本遊戲及服務網站整體的知識產權及版權作品的版權，包括用以提供本遊戲的電腦原始碼、圖形、用戶介面及影音內容，以及本遊戲上的所有元素組合。我們保留一切未經本服務條款明確授予的權利；
(h) 您就本遊戲及／或有關內容所作出或與其相關的任何行為概不會致使您獲轉讓任何知識產權，或授特許權利行使任何知識產權；
(i) 除另有明文規定外，任何增強或提升本遊戲的新元素均受本服務條款約束；及
(j) 本公司可隨時以任何方式或透過任何媒介，於您使用的任何電腦及／或流動裝置設置及／或安裝有關軟件，以監測從本遊戲下載、複製、儲存、錄製、分發、分享或重新定向任何有關內容的行為。

6. 虛擬貨幣及虛擬物品

6.1 本遊戲設有虛擬貨幣（包括但不限於金幣、符石及百樂卷等，以下統稱「虛擬貨幣」）供購買，您可購買虛擬貨幣以換取本應用程式內提供的特別服務﹑特性﹑功能及其他虛擬物品 (以下統稱「虛擬物品」)。

6.2 虛擬貨幣及虛擬物品只限成年或未成年但獲其父母/合法監護人同意的本遊戲帳戶持有人購買。

6.3 虛擬貨幣屬本遊戲的內容，故購買虛擬貨幣僅獲授予可以虛擬貨幣換取虛擬物品。您確認並同意:

(a) 您並未取得虛擬貨幣﹑虛擬物品或其他內容的所有權或產權；
(b) 虛擬貨幣及虛擬物品不存在任何貨幣價值，亦不構成法定貨幣或任何類型的財產；
(c) 虛擬貨幣只可換取虛擬物品，不能藉以向我們或其他人出售﹑轉讓或兌換真實貨幣﹑物品或服務；
(d) 您只可直接經我們及我們提供的途徑取得虛擬貨幣及/或虛擬物品，不得透過其他未經授權的平臺﹑兌換點﹑經紀人或管道取得；
(e) 不可向其他個人或用戶售賣或轉讓任何虛擬貨幣或虛擬物品；
(f) 我們有權取消任何違反本服務條款規定而出售﹑轉讓或交換的虛擬貨幣或虛擬物品，亦可終止違反規定的本遊戲帳戶；
(g) 我們有權因任何原因取消任何虛擬貨幣或虛擬物品的出售、轉讓或交換，包括但不限於：(i) 可用於此類出售、轉讓或交換的數量限制，(ii) 不準確或錯誤之產品或定價訊息，或 (iii) 避免欺詐或不當使用。
(h) 我們有權隨時更改虛擬貨幣及虛擬物品的售價﹑供應量﹑特性及規格等而無需任何通知；
(i) 虛擬貨幣及虛擬物品一徑購買，恕不更換或退款；
(j) 我們有權隨時就購買虛擬貨幣及虛擬物品向用戶提供贈送﹑折扣或其他獎賞；及
(k) 根據香港法律，虛擬貨幣及虛擬物品不構成法定財產權。

7. 程式錯誤、缺陷和意外更改

7.1 您確認已明白，儘管我們盡了最大努力，本遊戲可能包含程式錯誤 (Bug)、缺陷 (error) 或其他可能影響遊戲玩法的意外更改（「意外變更」），包括但不限於角色能力、物品屬性或遊戲機制的變更。

7.2 我們確認任何意外變更均屬無意，並非故意「削弱」或更改遊戲元素的一部分。

7.3 我們鼓勵您在發現遊戲中的任何意外變更時立即透過公司提供的官方管道報告，以協助我們維持和提高本遊戲的品質。

7.4 我們將盡合理努力及時解決報告的問題，但不保證立即修復或恢復先前的遊戲狀態。

7.5 我們保留確定哪些報告的問題構成需要糾正的意外變更，以及哪些可能被視為正常遊戲變化的一部分的權利。

8. 軟件許可

8.1 本公司會不時要求您從本遊戲下載軟件、應用程式及／或程式（「有關軟件」），本公司謹此授予您非獨家且不可轉讓的許可，以讓您按照本服務條款和有關軟件隨附的任何軟件許可在您的電腦及／或流動裝置儲存、運作及使用有關軟件（而不包括進一步或其他許可）。

8.2 您同意在個人電腦及／或其他流動裝置（如相容）下載及安裝有關軟件，讓您用作進入及／或安裝本遊戲。您不得將有關軟件或使用有關軟件的權利向他人再許可、轉讓、租賃或分發。

8.3 您確認倘若您未能成功下載並安裝有關軟件，本公司可拒絕向您提供本遊戲。

9. 個人資料

9.1 本公司按照載於服務網站及/或本公司私隱政策收集、處理、披露、保留或使用您的個人資料。

9.2 若本公司要求您提供個人資料，您可以拒絕提供，但本公司可拒絕為您提供本遊戲及/或任何有關內容。

9.3 您須向本公司提供本公司有理由要求關於您及您使用本遊戲的資料：

(a) 以便協助本公司履行適用法律，並向任何政府或監管機關呈報履行該責任的事項；及
(b) 以便評估您是否已履行、正在履行或有能力繼續履行您在本服務條款下的所有責任。

9.4 本公司可使用第三者廣告公司追蹤及／或衡量本遊戲、服務網站及其他網站的廣告效益。該等公司可使用有關您造訪本遊戲、服務網站及此等網站的資料（不包括您的姓名、地址、電郵地址或電話號碼或任何能夠識別您身份的資料），以衡量廣告效益及提供您感興趣的貨品及服務廣告。

9.5您同意本公司可以收集、使用、儲存、展示您的遊戲數據及其他數據包括登錄數據、使用量、機種、作業系統、網絡連線、數據用量及地點。

9.6 您同意您的個人資料可能傳輸至香港以外地區（包括中國內地），並受當地法律約束。我們將採用合同或技術保障措施，確保該等傳輸符合香港《個人資料（私隱）條例》（第486章）之要求。

10. 彌償

10.1 您同意就任何因下列或與之相關的事項而令本公司、本公司員工、本公司的內容供應商、次承辦商、許可人及代理蒙受或招致的訴訟、法律責任、費用、索償、損失、損害、法律程式及╱或支出作出彌償：

(a) 您使用或他人透過您的電腦、流動裝置及/或登記帳戶使用本遊戲、有關內容、服務網站及／或有關軟件；
(b) 您違反或不遵守本服務條款的任何條款；或
(c) 一切索償時所產生按完全彌償基準計算的合理法律費用。

10.2 第10.1條在本公司與您的本遊戲及／或有關內容協議終止後將繼續生效。

11. 我們的責任

11.1 以下條款列出我們涉及(i)違反本服務條款；及(ii)任何陳述、聲明或侵權行為或遺漏 (含因本服務條款所因致的過失)的法律上之責任範圍（包括但不限於因我們僱員之行為或遺漏所引致的法律責任）。

(a) 除非適用之當地法律另有規定者，本服務條款不包含任何默示的保證、條件，以及其他由成文法或普通法所默示的條款。
(b) 在法律允許之最大範圍內，我們及我們的授權人不會因您的使用、不當使用、不能存取／使用或依據本遊戲，或是因本遊戲的中斷、暫停或終止而引致的損失、毀壞或損害（包括由第三者引致之損害）負上任何法律責任，不論是基於保證、條件、合約、侵權（含疏忽）、錯誤之陳述、不實之陳述等與否，即使我們或其授權人已事前被告知發生此類損害的可能性亦同。這一免責條款亦適用於(但不限於)您獲取替代服務時所引致之成本、收入損失或數據丟失。此項免責條款進一步適用於我們根據本服務條款履行或無法履行本遊戲之一切法律責任；
(c) 凡因任何由本服務條款引致或所遭受之衍生性損失或損害（不論是收入損失、業務損失或其他損失或損害）、成本、費用或任何其他索償（不論訴訟因由），我們一概不會承擔任何法律責任。
(d) 不論任何情況下，如果您向我們提出索償（包括但不限於合約、侵權（含疏忽）、錯誤之陳述、不實之陳述等），我們應承擔之責任以不超過壹佰（100）美元為限。此責任限制不適用於因欺詐、故意不當行為或重大過失而產生的責任。

11.2本服務條款不豁免或局限我們因過失引致他人死亡或人身傷害的法律責任。

12. 終止服務

12.1 本公司可隨時終止向您提供本遊戲及／或任何有關內容，而不給予任何通知。如出現以下情況，本公司可立即暫停或終止您進入本遊戲或取消您的本遊戲帳戶而無須事先通知：

(a) 您的本遊戲帳戶超過一年沒有使用;
(b) 您違反本服務條款;
(c) 我們懷疑您欺詐或不當使用虛擬貨幣﹑虛擬物品或其他內容;
(d) 我們懷疑您的本遊戲帳戶有任何違法活動; 或
(e) 為維護本遊戲、其他用戶或本公司聲譽所必需之行動（包括但不限於用戶公開詆毀本遊戲或從事欺詐行為）。

12.2 無論您的帳戶因任何原因被取消或終止，您將不能再進入您的帳戶，帳戶內未經使用的虛擬貨幣及虛擬物品均不會獲得任何退款或補償，所有在您帳戶內或儲存在本遊戲內的訊息及內容均可能會（但不一定必須）被我們於終止後30日內刪除，除非法律要求延長保留期限。我們不會就因取消或終止您的帳戶而引致的訊息或內容刪除負任何責任。

12.3 如您為某一公會成員而該公會被取消或終止，您將無法取得張貼於該公會的任何內容，該等內容可能會（但不一定必須）被我們刪除，我們無須為此刪除負任何責任。

12.4 在終止您本遊戲的使用或本遊戲帳戶時，所有根據本服務條款授予您的特許權、權利及優惠將予以終止。任何該等終止慨不影響雙方任何累算的權利或責任，亦不影響明示或不言明意在該等終止當時或其後會生效或繼續生效的任何本服務條款下的條文之生效或繼續生效。

13. 更改本服務條款

13.1 我們保留無須任何原因、通知或責任隨時修改本服務條款的權利，以配合法律、合作夥伴及/或可向您提供的本遊戲的改變。如您不同意修改後的條款及條件，請勿繼續使用本遊戲。

13.2 任何本服務條款的更新版本將取締及取代本服務條款，而本服務條款亦在該更新版本條款生效之時隨即終止。

14. 一般條款

14.1 本條款受香港法律管轄。雙方同意按香港國際仲裁中心調解規則進行調解。若60日內未解決，任一方可向香港法院提出訴訟。

14.2 若本服務條款中的任何條款因任何理由變成或被法院宣佈為不合法、無效或不能執行，則該條款之全部或部分將從本服務條款中分割及刪除，其餘部分則根據該條款之立約原意及精神予以修改。本服務條款其他部分仍然有效。

14.3 除非另有明示，本服務條款不能構成及解釋為合約雙方以外之第三者享有根據香港法例第623章《合約（第三者權利）條例》有關本服務條款的任何權利。

14.4 您同意遵守香港法律，尤其是所有有關商品、服務、電腦軟件及技術數據之出口的相關法例、附屬法例、規則及行政命令等，不論閣下所身處之司法管轄區為何。當您使用本遊戲時，您於任何情況下仍然受到身處之地的當地法律管轄。

14.5 本遊戲及服務網站的伺服器設置於不同的地區，包括但不限於中國、中國香港及歐洲。您同意及確認您所提供的資料包括敏感的個人資料將會以自願性質傳送到上述地區。您確認您的個人資料之收集、使用、儲存及分享將會受到香港法律管轄，而不是您所身處的地方之法律管轄。

14.6 對於因不可抗力（包括但不限於天災、疫情、政府行為、網絡攻擊、勞工罷工或基礎設施故障）導致之服務暫停或終止，本公司不承擔責任

14.7 本服務條款構成合約雙方之間有關標的事項之完整協議，取締及取代所有先前或同時期的口頭或書面的協議（包括但不限於任何之前的條款及條件）。

14.8 除非經本遊戲的授權代表書面簽署同意，任何本服務條款之條文的寬免一律無效。

14.9 如本中文版本與英文版本遇有歧異，一律以英文版本為準。

Welcome to "Pet Star" (hereinafter referred to as the "Game"). The following Terms of Service (including related links and policies, collectively the "Terms") apply to all visitors and/or users who access and/or use the Game and/or any services provided on the Game and/or the official website (https://ps.xpecgame.com/index.html) and its affiliated websites (collectively, the "Service Website"). By accessing and/or using the Game and/or Service Website, you agree to be bound by these Terms.

1. The Game and Service Website

1.1 You may download and use the Game only on devices with compatible operating systems, as specified in the system requirements provided within the Game and Service Website.

1.2 Mobile data charges may apply when using the Game via mobile networks. Please consult your mobile service provider for details.

1.3 The Game, Service Website, and related webpages are owned or controlled by us and are provided to deliver information about the Game and facilitate your use thereof.

1.4 Our grant of access to and use of the Game and related content is conditional upon your strict compliance with these Terms.

2. Our Rights and Responsibilities

2.1 "We," "us," or "our" refers to XPEC ENTERTAINMENT LIMITED and/or its affiliates providing the Game under these Terms.

2.2 We reserve the right to:

(a) Modify, suspend, add, or remove any features or functionalities of the Game (including but not limited to adjusting gameplay rules, removing in-game items, character experience/levels, interactive maps, item effects, quest conditions, and controls) at any time;
(b) Suspend the Game for maintenance, upgrades, testing, or repairs without prior notice;
(c) Restrict or suspend your access to the Game if we deem your use violates these Terms, without notice; and
(d) Modify, remove, or restrict any part of the Game or related content if we determine it violates applicable laws, regulations, or is otherwise unacceptable.
(e) Take necessary administrative actions through Game Masters ("GM"), including but not limited to removing non-compliant content or imposing temporary or permanent chat restrictions ("Restrictive Measures") on users. The duration of Restrictive Measures shall be determined at our sole discretion based on the nature, severity, historical records of the violation, and other relevant factors. Prohibited content includes, without limitation:

(i) Statements damaging to our or the Game's goodwill or reputation;
(ii) Content causing distress, panic, or harassment to other users;
(iii) Dissemination of obscene, gambling-related, violent, or other materials illegal under the laws of Hong Kong.

3. Your Account

3.1 You must be a natural person of legal age in your country of residence and not prohibited from using our services. You must be at least 13 years old (or older if your jurisdiction's age of majority is higher) and, if under the age of majority, have parental/guardian consent to these terms.

3.2 Registration of an account ("Account") is required to access certain Game features. We may reject or cancel any Account registration at our sole discretion without liability.

3.3 You are responsible for maintaining the confidentiality of your Account login credentials ("Credentials"). You agree to notify us immediately of any unauthorized use or suspected compromise of your Credentials.

4. Your Obligations

4.1 You:

(a) May use the Game and related content solely for personal, non-commercial purposes;
(b) Shall comply with all applicable laws and codes of conduct;
(c) Shall report any violations of these Terms; and
(d) If submitting content to the Game:

(i) Warrant that such content does not infringe third-party rights (including intellectual property) or violate laws;
(ii) Shall not submit obscene or defamatory content;
(iii) Grant us a non-exclusive, perpetual, transferable, sublicensable, royalty-free, worldwide license to use submitted content;
(iv) Acknowledge we may remove content violating these Terms at our discretion.

4.2 You agree NOT to:

(a) Use the Game for commercial purposes;
(b) Copy, modify, distribute, sell, reverse-engineer, or extract source code from the Game, except as permitted by law;
(c) Disrupt others' access to the Game (e.g., via hacking);
(d) Use unauthorized third-party tools (e.g., plug-ins, cheats, bots, hacks, mods) to alter gameplay or enable non-human behavior;
(e) Interfere with the Game's servers or networks; or
(f) Engage in any actions that disrupt game balance (including but not limited to exploiting bugs for unfair advantages or manipulating in-game economies)

5. Exclusive Clauses

5.1 You acknowledge:

(a) The information provided through this game and the service website is offered strictly on an "as-is" and "as-available" basis, without any express or implied warranties or conditions (whether arising under statute or common law). Specifically, we make no warranties or guarantees, express or implied, regarding the accuracy of the content, its fitness for a particular purpose, non-infringement, uninterrupted service, reliability, security, timeliness, or freedom from computer viruses. We accept no liability for any errors, omissions, misstatements, or misrepresentations — whether express or implied — in such information.
(b) This game and/or the service website may contain materials provided by third parties and hyperlinks to external websites. We explicitly state that such materials and hyperlinks are neither approved nor endorsed by us. As these external websites are beyond our control, their privacy, security, or connectivity standards may differ from ours. The inclusion of third-party materials or links to external websites does not imply any form of association or affiliation between us and such third parties or websites, nor does it constitute an express or implied endorsement, representation, or warranty by us regarding such materials or sites. Any communications or transactions between you and third-party advertisers, or your participation in their promotions, are solely between you and the relevant advertiser. We shall not be liable for any loss or damage of any kind incurred as a result of any such dealings or the presence of links and advertisements on the game and/or service website.
(c) We may, from time to time, automatically download and install updates, upgrades, or additional features through the app publisher. Once new updates, upgrades, or features are released, we are not obligated to support older versions of the game, nor are we required to make older versions available for download—even if your device does not support the updated version.
(d) We shall not be liable in any way for any loss, damage, or harm (including but not limited to indirect or consequential loss, damage, or harm) resulting from or related to: – your use or misuse of the game or reliance on any information transmitted through the game or the service website; – your inability to use the game; – the content of any third-party materials or external websites transmitted or provided through the game or service website; or – your inability to access or use the game or service website.
(e) We make no representations, promises, warranties, undertakings, or guarantees regarding the quality, resolution, completeness, accuracy, usefulness, continuity, smoothness, or timeliness of the game or the service website.
(f) When you use links within the game that direct you to other pages or websites, such use may be subject to additional or different terms and conditions. In such cases, these Terms of Service and the additional terms shall both apply. If there is any conflict, the additional terms and conditions shall prevail.
(g) We own all intellectual property rights and copyrights in the game and the service website as a whole. This includes, without limitation, the source code, graphics, user interface, audiovisual content, and the combination of elements used to provide the game. All rights not expressly granted under these Terms of Service are reserved.
(h) Your actions in connection with the game and/or its content shall not result in any transfer of intellectual property rights to you, nor shall they be deemed to grant any license to exercise any intellectual property rights.
(i) Unless expressly stated otherwise, any enhancements or new features added to the game shall be governed by these Terms of Service.
(j) We may, at any time and in any manner or through any medium, install or configure relevant software on your computer and/or mobile device used to access the game, for the purpose of monitoring any acts of downloading, copying, storing, recording, distributing, sharing, or redirecting any related content from the game.

6. Virtual Currency and Virtual Items

6.1 The Game offers virtual currency (e.g., coins, runes, Bailei tickets; "Virtual Currency") for purchase to acquire virtual items ("Virtual Items").

6.2 Only adults or minors with parental consent may purchase Virtual Currency/Items.

6.3 You agree:

(a) You acquire no ownership rights to Virtual Currency/Items;
(b) Virtual Currency/Items have no monetary value;
(c) Virtual Currency cannot be sold, traded, or exchanged on secondary markets or unauthorised platforms;
(d) Purchases must occur through authorized channels;
(e) Resale/transfer of Virtual Currency/Items is prohibited;
(f) We may cancel illicit transactions or terminate Accounts;
(g) We may restrict sales/transfers at our discretion;
(h) Prices/availability of Virtual Currency/Items may change without notice;
(i) All purchases are final;
(j) We may offer promotions for purchases;
(k) Virtual Currency and Virtual Items do not constitute property rights under Hong Kong law.

7. Bugs, Errors, and Unintended Changes

7.1 You acknowledge the Game may contain bugs, errors, or unintended changes ("Unintended Changes") affecting gameplay (e.g., character abilities, item attributes).

7.2 We confirm Unintended Changes are unintentional and not deliberate nerfs.

7.3 Please report Unintended Changes via official channels.

7.4 We will reasonably attempt to resolve issues but do not guarantee fixes.

7.5 We retain sole discretion to determine what constitutes an Unintended Change.

8. Software License

8.1 We grant you a non-exclusive, non-transferable license to download/use Game-related software ("Software") per these Terms and any accompanying licenses.

8.2 You may install the Software only on compatible personal devices. Redistribution is prohibited.

8.3 Failure to install required Software may result in denied access.

9. Personal Data

9.1 We process personal data in accordance with our Privacy Policy and the requirements of Hong Kong's Personal Data (Privacy) Ordinance (Cap. 486).

9.2 Refusal to provide requested data may result in denied access.

9.3 You must provide data to comply with laws or assess your compliance with these Terms.

9.4 Third-party advertisers may track ad performance using non-identifiable data.

9.5 We may collect/use your device data (e.g., login records, usage, location).

9.6 You agree that your personal data may be transferred other jurisdictions including but not limited to China, and all your personal data will also be protected under the data privacy law correspondingly. We will implement contractual or technical safeguards to ensure such transfers comply with the Personal Data (Privacy) Ordinance (Cap. 486).

10. Indemnification

10.1 You agree to indemnify us against claims arising from:

(a) Your or others' use of the Game via your Account/device;
(b) Your breach of these Terms; or
(c) Reasonable legal fees incurred on a full indemnity basis.

10.2 This clause survives termination of these Terms.

11. Liability

11.1 The following provisions set out the extent of our legal liability in connection with: (i) breaches of these Terms of Service; and (ii) any representations, statements, tortious acts or omissions (including negligence arising out of or in connection with these Terms of Service), including, but not limited to, any liability resulting from the acts or omissions of our employees.

(a) Unless otherwise required by applicable local law, these Terms of Service do not include any implied warranties, conditions, or other terms implied by statute or common law.
(b) To the fullest extent permitted by law, we and our licensors shall not be liable for any loss, damage, or harm (including harm caused by third parties) resulting from your use, misuse, inability to access or use, or reliance on the game, or from any suspension, interruption, or termination of the game. This applies regardless of the legal basis of the claim, whether based on warranty, condition, contract, tort (including negligence), misrepresentation, or otherwise, and even if we or our licensors were advised in advance of the possibility of such damages. This exclusion of liability also covers (but is not limited to) costs incurred from acquiring substitute services, loss of revenue, or loss of data. It further applies to all liabilities arising from our performance or non-performance of the game under these Terms of Service.
(c) We shall not be liable for any indirect or consequential losses or damages resulting from or related to these Terms of Service—this includes (but is not limited to) loss of revenue, loss of business, or any other losses, damages, costs, expenses, or claims of any nature, regardless of the legal basis of the claim.
(d) In any case, if you bring a claim against us—whether based on contract, tort (including negligence), misrepresentation, or otherwise—our total liability to you shall not exceed one hundred (100) US dollars. This limitation shall not apply to liability arising from fraud, wilful misconduct, or gross negligence.

11.2 This clause does not limit liability for death/personal injury caused by negligence.

12. Termination

12.1 We may terminate your access to the Game/Account immediately if:

(a) Your Account is inactive for one year;
(b) You breach these Terms;
(c) Fraud/misuse is suspected;
(d) Illegal activity is suspected; or
(e) Actions necessary to protect the reputation of the Game, other users, or us (including but not limited to public disparagement of the Game or fraudulent activities).

12.2 Upon termination, unused Virtual Currency/Items are forfeited without refund. Account data may be deleted within 30 days of termination unless required to be retained by law.

12.3 Guild-related content may be deleted if a guild is terminated.

12.4 Termination does not affect accrued rights/obligations or surviving clauses.

13. Amendments

13.1 We may modify these Terms at any time. Continued use constitutes acceptance.

13.2 Updated Terms supersede prior versions upon effective date.

14. General

14.1 These Terms are governed by Hong Kong law. Parties shall attempt mediation through HKIAC under its Mediation Rules. If unresolved within 60 days, either party may commence litigation in Hong Kong courts.

14.2 If any clause is invalid, the remainder remains enforceable.

14.3 No third-party rights are conferred under Hong Kong's Contracts (Rights of Third Parties) Ordinance (Cap. 623).

14.4 You must comply with export laws and local laws where applicable.

14.5 Data may be transferred to servers in China, Hong Kong and Europe, etc., governed by Hong Kong law. You acknowledge that the collection, usage, storage and transfer will be governed under PDPO (Cap. 486) in Hong Kong, rather that the jurisdiction you located.

14.6 We shall not be liable for service suspension or termination due to force majeure events, including but not limited to acts of God, pandemics, government restrictions, cyberattacks, labour strikes, or infrastructure failures.

14.7 These Terms constitute the entire agreement between parties.

14.8 Waivers are valid only if signed by our authorized representative.
